This Privacy Policy describes how The Backseat Pilot, LLC ("we," "us," or "our") collects, uses, and shares information about you when you use BackseatPilot.app (the "Platform"). By using the Platform, you agree to the practices described in this Privacy Policy.

1. Information We Collect

Information You Provide

  • Email address (used for account creation and authentication)

  • Any information you voluntarily provide in communications with us

Information Collected Automatically

When you use the Platform, we automatically collect certain information, including:

  • Usage data: pages visited, features used, study phase activity, session duration, and interaction patterns

  • Device and browser information: browser type, operating system, device type, and IP address

  • Log data: server logs, error logs, and performance data

  • Behavioral analytics: how you navigate the Platform, which features you use or do not use, and where you drop off in workflows

AI Interaction Data

When you interact with AI-powered features on the Platform (including the BSP AI Assistant and Captain Mike mock examinations), we collect and retain conversation transcripts and interaction data. This data is used to:

  • Deliver the AI service to you

  • Monitor AI system performance and quality

  • Improve AI model behavior and Platform features

Live Class Data

If you attend live Class Pass sessions, those sessions are conducted over a third-party video conferencing service (Zoom) and are recorded. In connection with live classes, we and our video conferencing provider may collect:

  • Audio and video of your participation, if your microphone or camera is on

  • Your display name as shown in the session

  • Questions, comments, chat messages, and other participation during the session

Recordings of live classes may be retained and made available to other members as part of the Platform's class recordings library, and may be used as described in the Class Pass Terms & Conditions at backseatpilot.com. If you prefer not to appear on video, you may join with your camera off; your audio and chat may still be captured if you choose to participate.

Payment Information

Purchases are processed by Shopify. We do not collect or store your payment card information directly. Please review Shopify's privacy policy for information about how your payment data is handled.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the Platform and its features

  • Authenticate your identity and manage your account

  • Analyze usage patterns to understand what is working and what needs improvement

  • Personalize your experience on the Platform

  • Communicate with you about your account, updates, and support

  • Monitor and ensure the security and integrity of the Platform

  • Comply with applicable legal obligations

3. Analytics and Tracking

We use third-party analytics tools, including PostHog, to help us understand how users interact with the Platform. These tools may collect information about your usage behavior, device, and interactions. This data is used in aggregate and at the individual account level to improve the Platform.

We use AI observability tools, including Arize Phoenix, to monitor the performance and quality of our AI systems. Conversation data may be reviewed as part of this monitoring.

4. How We Share Your Information

We do not sell your personal information. We may share your information with:

  • Service providers: Third-party companies that help us operate the Platform, including hosting (Railway), analytics (PostHog), AI services (OpenAI), text-to-speech (ElevenLabs), AI observability (Arize), email (Resend), payment processing (Shopify), and video conferencing for live classes (Zoom). These providers are authorized to use your information only as necessary to provide services to us.

  • Legal requirements: If required by law, regulation, or legal process, or to protect the rights, property, or safety of The Backseat Pilot, LLC or others.

  • Business transfers: In connection with a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the Services. You may request deletion of your account and associated data by contacting us at info@backseatpilot.com. We will honor deletion requests subject to any legal obligations to retain certain data.

Recordings of live classes in which you appear or participate may be retained as part of our educational content library and may remain available to members even after you close your account. Closing your account does not require us to edit, remove, or recall recordings that have already been created or distributed.

6. Security

We implement reasonable administrative, technical, and physical safeguards to protect your information. However, no method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee absolute security of your data.

7. Your Choices

You may:

  • Access or update your account information by logging into your account

  • Request deletion of your personal data by contacting info@backseatpilot.com

  • Opt out of non-essential communications by following unsubscribe instructions in our emails

Note that some data is necessary for the Platform to function. If you request deletion of all data, your account will be closed.

8. International Users

The Platform is operated in the United States. If you access the Platform from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States. By using the Platform, you consent to this transfer. We do not currently offer GDPR-specific data subject request handling, but we will work in good faith to accommodate reasonable requests from international users.

9. Children's Privacy

The Platform is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us at info@backseatpilot.com and we will promptly delete it.

10. Third-Party Links

The Platform may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party sites you visit.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the effective date above. If we make material changes, we will notify registered users by email or by a prominent notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated Privacy Policy.
