Please read these Terms of Service carefully before using BackseatPilot.app (the "Platform"). By creating an account or accessing any part of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

BY USING THE PLATFORM, YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

Educational and Informational Purposes Only

All content on BackseatPilot.app — including lesson plans, study materials, AI-generated feedback, mock examination results, readiness scores, and any other information provided through the Platform — is intended solely for general educational and informational purposes. Nothing on the Platform constitutes official FAA instruction, an endorsement by the FAA or any regulatory body, or a guarantee of any outcome in any aviation examination, certification, or real-world flight operation.

No Guarantee of Checkride Performance or Certification

Completion of any study phase, achievement of any score, or use of any feature on the Platform does not guarantee that you will pass any FAA practical test, written examination, or checkride. The Platform is a study aid only. Final determination of readiness for any aviation certification rests solely with qualified human flight instructors and FAA-designated examiners.

Readiness Score Disclaimer

The Readiness Score displayed on the Platform is a general study progress indicator provided for informational and educational guidance only. It is not a clinical assessment, a professional evaluation, or a predictor of checkride success. The Readiness Score does not reflect official FAA standards, is not validated against actual checkride outcomes, and should not be interpreted as a guarantee or assurance of any level of aviation competency. Use it as a general guide to structure your studies — nothing more.

Aviation Safety — Use at Your Own Risk

Aviation is an inherently high-risk activity. Nothing on this Platform should be used as the sole basis for any decision made in an actual aircraft or real-world aviation context. You assume full and sole responsibility for any actions you take in an aircraft or aviation environment, regardless of any information, feedback, or content encountered on the Platform. The Backseat Pilot, LLC expressly disclaims all liability for any injury, death, property damage, regulatory violation, or other harm arising from your use of or reliance on any content on the Platform in connection with actual flight operations or aviation activities of any kind.

AI-Generated Content

The Platform uses artificial intelligence to generate study content, evaluation feedback, and examination simulations. AI-generated content may contain errors, omissions, or inaccuracies. You are solely responsible for independently verifying all information against official FAA publications, current regulations, and guidance from qualified aviation professionals before applying it in any real-world context.

1. About Us

BackseatPilot.app is operated by The Backseat Pilot, LLC, a limited liability company. References to "we," "us," or "our" in these Terms refer to The Backseat Pilot, LLC. You can reach us at info@backseatpilot.com.

2. The Platform

BackseatPilot.app provides an AI-powered study and preparation platform for aviation training, including but not limited to Certified Flight Instructor (CFI) checkride preparation. The Platform includes structured lesson plans, AI-assisted study tools, mock oral examinations, readiness tracking, live online classes ("Class Pass"), access to recordings of those classes, and related features (collectively, the "Services").

Live Class Pass sessions are conducted over a third-party video conferencing service and are recorded. The terms governing your participation in live classes — including your consent to be recorded and how those recordings may be used — are set out in the Class Pass Terms & Conditions available at backseatpilot.com, which apply to those sessions in addition to these Terms.

The Platform is intended for educational and informational purposes only. It does not constitute official FAA instruction, certification, or endorsement of any kind.

3. Eligibility

You must have the legal capacity to enter into a binding contract in your jurisdiction to use the Platform. By using the Platform, you represent that you meet this requirement.

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information during registration

  • Keep your account credentials secure and confidential

  • Notify us promptly at info@backseatpilot.com if you suspect unauthorized access to your account

  • Be responsible for all activity that occurs under your account

We use email-based magic link authentication. You are responsible for maintaining access to the email address associated with your account.

5. Purchases and Payment

Purchases of subscriptions or other access to the Platform are processed through our e-commerce partner, Shopify. By completing a purchase, you also agree to Shopify's applicable terms. We do not store your payment card information directly.

Subscriptions are billed on a recurring basis (for example, monthly) and automatically renew at the then-current price at the end of each billing period until you cancel. You may cancel at any time; your cancellation stops future charges, and you will retain access through the end of the current paid period. Except where required by applicable law, fees already paid are non-refundable, and we do not provide refunds or credits for partial billing periods or unused access.

6. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Platform in any way that violates applicable federal, state, or local law or regulation

  • Reproduce, distribute, modify, or create derivative works of any Platform content without our written permission

  • Record, screenshot, or redistribute any live class session, class recording, or class materials without our prior written permission

  • Attempt to gain unauthorized access to any portion of the Platform or its related systems

  • Use automated tools, bots, or scrapers to access the Platform

  • Share your account credentials with third parties

  • Use the Platform to transmit any harmful, harassing, or unlawful content

  • Attempt to reverse-engineer, decompile, or extract the source code of the Platform

7. AI-Generated Content

The Platform uses artificial intelligence to generate study content, evaluation feedback, mock examination responses, and other materials. Please review the Important Disclaimers section at the top of these Terms for full details on the limitations of AI-generated content. You additionally acknowledge that:

  • The AI examiner ("Captain Mike") is a simulated practice tool only and is not affiliated with, endorsed by, or representative of the FAA or any Designated Pilot Examiner

  • AI scoring, feedback, and readiness indicators are study aids only and carry no official weight

  • You are solely responsible for verifying all content against current official FAA publications before applying it in any real-world context

8. Intellectual Property

All content on the Platform, including lesson plans, software, graphics, text, AI systems, and design, is owned by or licensed to The Backseat Pilot, LLC and is protected by applicable intellectual property laws.

Your purchase grants you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial educational purposes. No ownership rights are transferred.

9. Third-Party Services

The Platform integrates with third-party services including but not limited to Shopify (payments), Zoom (live class video conferencing), ElevenLabs (text-to-speech), and OpenAI (AI/LLM services). Your use of these integrations is also subject to the respective third-party terms of service. We are not responsible for the practices or content of third-party services.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Aviation training involves serious safety considerations — always consult qualified human instructors and official FAA materials.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE BACKSEAT PILOT, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Backseat Pilot, LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Platform or your violation of these Terms.

13. Modifications to the Platform or Terms

We reserve the right to modify, suspend, or discontinue the Platform or any part of it at any time. We will make reasonable efforts to notify users of material changes to these Terms by updating the effective date above or by sending an email to registered users. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in the State of Illinois.
